Terms & Conditions


Definitions

a) 'Company' means 'Gold Star Mobility'

b) 'Customer' means any individual or company that has offered or intends to Purchase Goods from the Company.

c) 'Goods' means any product, component or service in whole or part there of, that has been sold to or proposing to sell to the Customer.

d) 'Purchase' means any goods bought or intended to be bought by the Customer.

e) ‘Service' means any work carried out on behalf of the Customer or at the Customers behest.

f) 'Agreement' means any transaction or intended transaction proposed between the Company and the Customer in relation to the Sale and/or Purchase of Goods.


By ordering through any method within our store or website the customer is entering into a contract with Gold Star Mobility.


If ordering from the website the Customer is responsible for verifying the suitability and compatibility of products prior to purchase. Incompatibility issues with products are not the responsibility of the Company.

To keep our prices competitive we dispatch our products by a courier service. To ensure the product reaches you in perfect condition we assemble and test the product, repacking before dispatch.


Delivery is usually within 2-10 working days from the day we receive your order, should you require it sooner let us know and we will make every effort to get it to you on time.


It is the responsibility of the Customer to ensure that Goods can be accepted at the delivery address once the Goods have been dispatched.  Deliveries will only be attempted twice and failure to provide for receipt of Goods ordered may incur an additional charge.


Should the Company be unable to provide the goods ordered within the stated time period, the Customer will be notified so that alternative arrangements can be made.  However, we cannot be held responsible for failed or late deliveries outside of the Company's control, where all reasonable efforts have been made to ensure goods are delivered correctly and on time. 


In the event of any damage, delay or loss of goods, due to mishandling in transportation the Customer is required to deal directly with the delivery company.


The Customer is responsible for inspecting goods upon delivery to ensure that there is no shortfall in quantity, damage to goods or incorrectly shipped items and is required to notify us within 48 hours of receiving the goods in writing, via the contact form on the website or by email.  Failure to notify us within the specified time period, then the goods shall be deemed to be suitable for use for its intended purpose and the sole property of the Customer.


We reserve the right not to ship any goods out for delivery until payment has been received in full.


Goods purchased will only be sent to the authorised delivery address, in the case of credit/debit cards, this will only ever be to the cardholders address.


Making A Purchase

a) Goods can be paid for by the Customer using cash, cheque (only when accompanied by a valid cheque guarantee card) or the following debit/credit cards: Delta, MasterCard, Solo, and Visa.


b) All prices shown exclude VAT, the price you see is the price you pay if a signed exemption form is received.  All items remain the sole property of the Company until the payment has been successfully processed and payment received in full.


c) All goods ordered from our store or website must be paid for in full before they are dispatched from us. Orders by credit/debit cards will be dispatched immediately; cheques require 5 working days to clear before we can dispatch your order. 


d) As part of the conditions of sale customers are required to inspect all goods on receipt and are to annotate the Courier's documentation with details of damage to either the packaging or the goods themselves. Where this is not done, and the Courier subsequently disputes liability, then Gold Star Mobility will not be responsible for the costs associated with repair or replacement. In all cases, damage to goods is to be reported to Gold Star Mobility at the earliest opportunity.


Warranty/Guarantee/After Sales Service

a) All new products supplied by us carry a manufacturers warranty for one year, excluding consumables providing they are used in accordance with the manufacturer’s guidelines. We provide a Free Phone number to call us on in case of any problems. We can be contacted during normal office hours from 9:00am – 5:00pm Monday to Friday during which time there is usually a Gold Star Mobility representative available to give you any advice you may require. If your Mobility Product should go wrong during this period then the product will need to be returned to us in order for us to carry out necessary repairs. 


b) Any unauthorised modification of products or components is done at the owners risk and may invalidate your warranty.

d) Please note the warranty does not cover consumables such as tyres and bulbs or maintenance requirements caused by undue care or accidental damage such as flat batteries or punctures. A call out requested or diagnosed as a result of the above will attract a minimum call out fee of £95 and may be subject to additional parts and labour charges.


Returns

a) In the event that your goods should be found faulty please contact us at: sales@goldstarmobility.co.uk


b) If any Goods need to be sent back within the first 28 days and are found to be faulty we will gladly refund the cost of postage and replace the item with the same or an equivalent at no additional cost.  Goods returned and found to be in good working order will be subject to a restocking fee of 15% of the value of the goods. 


c) All Goods returned must be in a resalable condition and in their original packaging must include manuals, cables, chargers and accessories.


d) The Customer agrees upon receipt of Goods purchased that any Goods not returned in accordance with this Agreement may be exempt from Guarantee and any refund or replacement for Goods may be made at the depreciated value for the Goods returned.


Cancellations

a) The Customer has the right to cancel their order within 7 days of the order being confirmed.  If the goods have already been dispatched for delivery the Customer accepts full responsibility for the safe return of the goods, taking reasonable care and attention to ensure that goods are returned in satisfactory condition in accordance with the Company’s Return policy.  The cost of returning goods relating to cancelled orders lies with the Customer and cannot be refunded by the Company.


b) Should it be necessary for the Company to retrieve the goods, a charge may be made for this, which may exceed the original cost and delivery of the goods.  This may also include an administration charge of 15% in addition to a restocking fee of 15% along with any other charges that may be incurred.



Limitation of Liability

a) The Company's liability in contract includes but is not limited to negligence, breach of statutory rights, misrepresentation, miscommunication or restitution in relation to the Company's adherence to this agreement shall be limited to the price for the goods at the time at the current market value.


b) The Company shall not be made liable for any indirect or consequential loss or damage to persons, property,or any supposed costs, expenses or consequential loss for compensation whatsoever that may be directly or indirectly related to the terms of this Agreement.


Force Majeure

a) The Company shall not be held liable for any event beyond their control that prevents fulfilling any or all aspects of this Agreement.  This may include but is not limited to natural disasters, war, terrorist activities, or the failure of third parties to perform their obligations.

Your Privacy

a) The information you supply to us will only be used to process and complete your order.  No information will ever be passed on to any 3rd party or used to send out unsolicited emails, as we respect your privacy. 


b) During the processing of your order, all reasonable efforts and precautions shall be made to keep the details or your Purchase confidential.  The Customer in turn agrees to take all reasonable precautions with any information provided to ensure that use or access to the Customers details are not misused, abused or used without their consent and does not hold the Company responsible for any negligence on the part of the Customer, whether intended or otherwise.

English Law

a) These terms are subject only to English law and the jurisdiction of the English courts should a dispute arise relating to this contract and are agreed not to be subject to laws outside of the jurisdiction of the United Kingdom.


All Rights Reserved

a) The Customers statutory rights are not affected.


b) All trademarks and company logo’s remain the property of their respective owners.  At no time do the views of the Company relate to the opinions or views of any other company.


c) These terms and conditions shall apply to and be incorporated in to every agreement between the Company and the Customer.


d) The terms of this contract may be changed or amended at any time without prior notice.


e) These terms and conditions supersede all previous terms and conditions of the Company.


f) These terms and conditions shall take precedence over any terms and conditions of the customer and shall not be varied without written or email consent from the Company.


g) The enforcement of whole or part of these terms is at the Company's discretion.
